“Mockkitaab” (hereinafter collectively referred to as the “Platform” or
“Service”) are owned, controlled, and operated by Mockkitaab.
Access to and use of the Platform and the Services provided therein are governed by these Terms
of Service (hereinafter referred to as the “Terms”). These Terms constitute a legally binding
agreement between Mockkitaab and any individual or entity who accesses, browses, registers on,
or otherwise uses the Platform in any manner whatsoever (hereinafter referred to as “User”,
“You” or “Your”).
By accessing, browsing, registering, or using any part of the Platform or the Services, you
represent and warrant that You have read, understood, and agree to be bound by these Terms,
including any policies, guidelines, or additional terms incorporated herein by reference, as
amended from time to time. If You do not agree to these Terms, you are not authorized to access
or use the Platform or the Services and must immediately discontinue such use.
Mockkitaab reserves the right, at its sole discretion, to amend, modify, update, or revise these
Terms at any time without prior notice. In the event of any material change, Mockkitaab shall
post a notice of such changes on the Platform for a reasonable period and shall indicate the
date on which the Terms were last updated. Any revised Terms shall become effective on the
earlier of (i) the expiry of the notice period or (ii) Your continued access to or use of the
Platform after such changes are posted. Your continued use of the Platform following any
modification shall be deemed to constitute Your acceptance of the revised Terms.
2. DESCRIPTION, NATURE AND SCOPE OF SERVICES
Mockkitaab is an educational technology platform designed to assist students and aspirants
preparing for government, competitive, and entrance examinations by providing mock tests,
MCQ-based question banks, answers with explanations, and other learning tools.
The Platform is not an examining authority, recruiting agency, coaching institute guaranteeing
results, or a government body. Mockkitaab does not conduct examinations nor does it issue
certificates, degrees, or recruitment confirmations.
All content and services provided on the Platform are intended solely for educational,
preparatory, and self-assessment purposes. Mockkitaab reserves the right to modify, suspend,
improve, or discontinue any part of the Service at its sole discretion without prior notice and
without incurring any liability.
3. ELIGIBILITY
Use of the Platform is permitted only to individuals who are legally competent to contract under
the Indian Contract Act, 1872. Users below the age of 18 years may access the Platform only
under the supervision of a parent or legal guardian. By using the Platform, You represent and
warrant that You meet the eligibility requirements and that all information provided by You is
accurate and truthful.
4. REGISTRATION AND USER ACCOUNT
Certain features of the Platform require registration. By creating an account, you agree to
provide accurate, current, and complete information and to keep such information updated at all
times.
You are solely responsible for maintaining the confidentiality of Your login credentials and for
all activities carried out through Your account. Mockkitaab shall not be responsible for any
loss or damage arising from unauthorized access caused due to Your failure to safeguard Your
credentials.
Mockkitaab reserves the right to suspend, restrict, or terminate any account found to be in
violation of these Terms or applicable law.
5. CONSENT TO COMMUNICATION
By registering on the Platform, you expressly consent to receive communications from Mockkitaab
through phone calls, SMS, emails, WhatsApp messages, or push notifications for purposes
including service updates, transactional information, examination alerts, promotional offers,
and product communication.
6. SUBSCRIPTIONS, FEES AND PAYMENTS
Certain services on the Platform may be available only upon payment of subscription fees.
Subscription plans may be monthly, quarterly, or annual and may be purchased through the Website
or App.
Payments may be processed through third-party payment gateways. Mockkitaab does not store or
process users’ card or banking details and shall not be liable for payment gateway errors,
delays, or failures.
All payments made towards subscriptions are non-refundable, except where refund is expressly
required under applicable law. Subscription prices may be modified at Mockkitaab’s discretion.
7. DISCLAIMER REGARDING RESULTS, SELECTION, AND OUTCOMES
Mockkitaab is solely an educational support platform and does not guarantee, assure, represent,
or warrant selection, qualification, passing marks, rank, score, cut-off clearance, interview
success, or recruitment in any examination or selection process conducted by any authority.
The mock tests, MCQs, explanations, difficulty levels, performance analysis, and predictive
insights available on the Platform are indicative and illustrative in nature only. Actual
examination patterns, standards, and results may differ substantially.
Performance in mock tests or practice modules shall not be treated as a predictor of actual
examination results. Any reliance placed on such content is entirely at the User’s own
discretion and risk.
Mockkitaab shall not be liable for any academic loss, examination failure, non-selection, career
setback, or professional decision taken by the User based on the Platform’s content. This
disclaimer forms a fundamental condition of use and shall survive termination of these Terms.
8. USER CONDUCT AND PROHIBITED USE
Users agree not to misuse the Platform or engage in any activity that is unlawful, harmful,
defamatory, obscene, misleading, or infringing upon the rights of others.
Users shall not copy, reproduce, scrape, distribute, sell, sublicense, reverse engineer, or
commercially exploit any content available on the Platform. Sharing of login credentials, use of
bots or automation tools, or attempts to compromise Platform security are strictly prohibited.
Violation of this clause may result in immediate suspension or termination of access and
initiation of legal proceedings.
9. INTELLECTUAL PROPERTY RIGHTS
All content available on the Platform, including but not limited to mock questions, answers,
explanations, databases, software code, algorithms, graphics, logos, trademarks, user interface
design, and overall look and feel (“Service Content”), is the exclusive intellectual property of
Mockkitaab or its licensors.
The Service Content is protected under the Copyright Act, 1957, Trade Marks Act, 1999,
Information Technology Act, 2000, and other applicable intellectual property laws.
No ownership rights are transferred to Users. Users are granted only a limited, revocable,
non-exclusive, non-transferable license to access the Platform for personal, non-commercial
educational use. Any unauthorized use of the Service Content shall constitute infringement and
may result in civil and criminal liability.
10. OWNERSHIP OF USER ACTIVITY DATA
All data generated through User interaction with the Platform, including test attempts, scores,
rankings, performance analytics, learning behavior, and system-generated insights (“Activity
Data”), shall remain the exclusive property of Mockkitaab.
By using the Platform, you irrevocably assign all rights, title, and interest in such Activity
Data to Mockkitaab. Mockkitaab may use such data for internal analytics, research, service
improvement, personalization, and compliance with legal obligations.
Activity Data shall not include personally identifiable information except as governed by the
Privacy Policy.
11. DISCLAIMER OF WARRANTIES
The Platform and Services are provided on an “AS IS” and “AS AVAILABLE” basis
without warranties of any kind, whether express, implied, or statutory.
Mockkitaab expressly disclaims all warranties relating to accuracy, completeness, reliability,
fitness for a particular purpose, uninterrupted availability, or error-free operation.
Mockkitaab does not warrant that the Platform will meet User expectations or that defects will
be corrected. To the extent permitted by law, all implied warranties are excluded.
12. LIMITATION OF LIABILITY
To the maximum extent permitted under law, Mockkitaab shall not be liable for any indirect,
incidental, special, consequential, or exemplary damages, including loss of data, loss of
income, loss of career opportunity, or examination-related losses.
Mockkitaab’s total liability, if any, shall not exceed the amount paid by the User to Mockkitaab
in the preceding twelve (12) months.
13. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Mockkitaab, its founders, directors, officers,
employees, agents, and affiliates from and against all claims, losses, damages, liabilities,
penalties, and expenses (including reasonable legal fees) arising out of Your use or misuse of
the Platform, breach of these Terms, violation of law, infringement of third-party rights, or
reliance on Platform content. This obligation shall survive termination.
14. TERMINATION
Mockkitaab reserves the right to suspend or terminate User access at any time, with or without
notice, for violation of these Terms or applicable law.
Upon termination, all rights granted to the User shall immediately cease. Provisions relating to
intellectual property, disclaimers, limitation of liability, indemnification, governing law, and
jurisdiction shall survive termination.
15. PRIVACY AND DATA PROTECTION
Mockkitaab is committed to protecting User data in accordance with the Information Technology
Act, 2000, IT Rules, 2011, and the Digital Personal Data Protection Act, 2023.
Collection, storage, processing, and use of personal data shall be governed by the Mockkitaab
Privacy Policy, which forms an integral part of these Terms. By using the Platform, you
expressly consent to such data practices.
16. GRIEVANCE REDRESSAL MECHANISM
In compliance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce)
Rules, 2020, Mockkitaab has established a grievance redressal mechanism.

17. COPYRIGHT INFRINGEMENT
Mockkitaab respects intellectual property rights. Any person who believes that content available
on the Platform infringes copyright under the Copyright Act, 1957 may submit a written complaint
with requisite details.
Upon receipt of a valid complaint, Mockkitaab may remove or disable access to the allegedly
infringing material without prior notice. False or malicious claims may attract legal
consequences.
18. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of
India. Courts at Kangra District in Himachal Pradesh state shall have exclusive
jurisdiction over all disputes arising out of or relating to these Terms or the Platform.
19. MISCELLANEOUS
These Terms constitute the entire agreement between the User and Mockkitaab. If any provision is
held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Failure by Mockkitaab to enforce any right shall not be deemed a waiver. Mockkitaab may assign
its rights and obligations under these Terms without restriction.
